1. Acceptance of these terms
These Terms of Service (the “Terms”) govern your access to and use of the Evalda website at evalda.euand the related services (together, the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The service
Evalda is a packaging-compliance assistant. It helps you assess packaging against the EU Packaging and Packaging Waste Regulation (PPWR, EU 2025/40) and related national schemes, run a Compliance Check, and obtain source-cited answers by text or voice. The Service is operated by Adara Srl — gussago (BS), via gramsci 45/a, CAP 25064 — n. REA BS-614246 — C.F. e P.IVA 04429800982(“Evalda”, “we”, “us”).
3. Eligibility and accounts
The Service is intended for business users and for individuals who are at least 16 years old. Some features require an account; you are responsible for the accuracy of your registration details, for keeping your credentials secure, and for activity that occurs under your account.
4. Acceptable use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- attempt to disrupt, overload, reverse-engineer or gain unauthorised access to the Service or its infrastructure;
- scrape, resell or redistribute the Service’s outputs or knowledge base except as expressly permitted;
- submit content you have no right to submit, or that infringes the rights of others;
- misuse the Service to generate unlawful, misleading or harmful content.
5. Your content
You retain ownership of the product, packaging and other data you submit (“Your Content”). You grant us a limited licence to process Your Content solely to operate and provide the Service to you. Personal data is handled as described in our Privacy Policy.
6. Intellectual property
The Service, including its software, design, text and the structure of its knowledge base, is owned by Evalda or its licensors and is protected by intellectual-property law. Official regulatory texts referenced by the Service remain subject to their own terms. These Terms grant you no rights other than to use the Service as intended.
7. No professional or legal advice
Evalda is a decision-support tool, not a substitute for professional advice. Its outputs — including Compliance Check results and assistant answers — are provided for information only and may be incomplete or inaccurate. You are responsible for verifying compliance with the applicable law for your specific case, and should obtain qualified legal, regulatory or technical advice before making decisions with legal or financial consequences.
8. Third-party content and sources
The Service cites and links to third-party sources, including the EU Official Journal and CONAI. We are not responsible for the content, availability or accuracy of third-party resources, and a link does not imply endorsement.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its outputs are complete or current.
10. Limitation of liability
To the maximum extent permitted by law, Evalda shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Suspension and termination
We may suspend or terminate access to the Service, in whole or in part, where you breach these Terms or where necessary to protect the Service or its users. You may stop using the Service at any time.
12. Changes to the service and to these terms
We may modify the Service and update these Terms from time to time. The current version is indicated by the “Last updated” date above; material changes will be signalled by appropriate means. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Italy and the applicable law of the European Union, without regard to conflict-of-laws rules. The courts competent for the seat of the provider shall have jurisdiction, subject to any mandatory consumer-protection rights.
